These Terms of Use (“Terms”) govern your access to and use of the Every Health LLC platform, including our website, mobile applications, and any related services or tools provided by Every Health LLC and its service providers (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, you must discontinue using the Services.
1. Revisions to These Terms
These Terms were last updated on the date indicated above. Every Health LLC reserves the right to update or revise these Terms at any time. If material changes are made, you will be notified when you next access the platform or Services. By continuing to use the Services after changes are posted, you accept the revised Terms. We will not make changes that diminish the protection of your personal information or violate applicable law.
2. Eligibility and Age Restriction
The Services are intended for use by individuals 18 years or older. By using the Services, you affirm that you are at least 18 years of age and have the legal authority to agree to these Terms. If you are under 18, you must stop using the Services immediately.

4. Description of the Services
The Services provide digital tools that allow users to access healthcare resources, communicate with healthcare professionals, and manage their health information. These tools may include features such as secure messaging, appointment scheduling, and access to health records. By continuing with the patient intake process, you agree to these Terms and our Consent to Treat Agreement.
In providing the Services, Every Health LLC and its affiliates may securely collect, access, and transmit your personal information, including:
- General Personal Information: Name, date of birth, and contact details.
- Health Information: Medical history, health records, and claims data.
- Communication Details: Email and mobile information for service-related communications (message and data rates may apply). You can opt-out of receiving these communications at any time.
5. Payment Terms & Recurring Billing Policy
By using the telehealth services, you agree to be responsible for all costs of services rendered and acknowledge that all services are self-pay and prepaid. As part of our commitment to delivering continuous care, Every Health LLC provides ongoing treatment plans that may involve recurring monthly billing. This policy explains how and when you will be charged for ongoing services, how to manage your subscription, and what to expect regarding billing and cancellations.
Automatic Recurring Payments
By electing to enroll in an ongoing treatment plan prescribed by a licensed healthcare provider through our platform, you authorize Every Health LLC to automatically charge your chosen payment method on a monthly basis for any ongoing services, treatments, or prescribed medications.
Recurring Charges: Charges will recur automatically each month on the billing date you agreed upon during enrollment.
Billing Details: Charges will cover services such as consultations, ongoing prescriptions, and any related subscription-based healthcare services.
Notifications: Prior to the first charge, you will be provided with a summary of your subscription, including the cost and frequency of charges.
Authorization for Payment By enrolling in a treatment plan, you:
- Authorize Every Health LLC or its third-party payment processors to charge your payment method for recurring payments.
- Acknowledge that charges may vary if your treatment plan changes, or if additional services or products are prescribed by your healthcare provider.
- Understand that your treatment plan and subscription are tied to your provider's recommendations, which may adjust as your care progresses.
Managing Your Subscription
Access to Account: You can view details of your subscription and billing history through your user account dashboard.
Changes to Treatment Plans: If your provider adjusts your treatment plan, corresponding changes in charges will be reflected in the following billing cycle.
Pausing or Canceling Subscriptions: You can cancel or pause your subscription at any time by contacting customer support or through your account dashboard. However, cancellations will only apply to future charges and will not affect charges already processed.
Cancellations and Refunds
Cancellation Policy: To avoid being charged for the next billing period, you must cancel at least 24 hours before your next scheduled billing date.
Refunds: Due to the nature of healthcare services, refunds are not provided for services already rendered.
Provider-Recommended Discontinuation: If your healthcare provider determines that the treatment should be discontinued, your subscription will be canceled without penalty.
Changes to Billing and Payment Terms
We reserve the right to change our billing or payment terms, including pricing and frequency of charges, with appropriate notice to you. You will be notified of any changes at least 30 days in advance, and continued use of the Services constitutes your acceptance of the updated terms.
Failed Payments
If a payment is unsuccessful, we will notify you and attempt to process the payment again. If the payment continues to fail, your access to ongoing services may be suspended until the issue is resolved.

6. Your Responsibility for Account Security
You are responsible for keeping your account credentials secure. Any activity under your account is your responsibility. If you believe your account has been compromised, contact us immediately. Every Health LLC is not liable for any unauthorized access due to your failure to protect your account credentials.
7. Prohibited Uses
By using the Services, you agree not to:
Use the Services for any unlawful or unauthorized purpose.
Misrepresent your identity or affiliation.
Attempt to access or interfere with other users’ accounts or our systems.
Disrupt or interfere with the functionality of the Services.
Upload viruses or harmful code.
Violation of these rules may result in the termination of your account and legal action.
8. Intellectual Property
All content available through the Services, including text, graphics, logos, icons, images, and software, is owned by Every Health LLC or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, revocable license to use the content for personal, non-commercial purposes.
9. Disclaimers and Limitation of Liability
The Services are provided on an “as is” and “as available” basis without warranties of any kind. Every Health LLC and its affiliates make no guarantees regarding the accuracy, reliability, or availability of the Services. We are not responsible for any indirect, incidental, or consequential damages arising from your use of the Services.
If you are dissatisfied with the Services, your sole remedy is to stop using them.
10. Use of Information and Privacy
We collect, use, and disclose personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree to the collection and use of your information as described in the Privacy Policy.
11. Communications
By using the Services, you consent to receive service-related communications, such as emails or SMS messages. Message and data rates may apply. You may manage or opt out of communications through your account settings.
12. HIPAA Compliance and Acknowledgment
Every Health LLC is committed to protecting your Protected Health Information (PHI) in compliance with the Health Insurance Portability and Accountability Act (HIPAA).
Confidentiality: Your PHI will only be used or disclosed as allowed by HIPAA and applicable laws.
Permitted Uses: Your PHI may be used for treatment, payment, and healthcare operations as outlined in our HIPAA Notice of Privacy Practices.

Security Measures: We use safeguards to protect your PHI, but no security system is foolproof.

14. Termination
We reserve the right to terminate your access to the Services at any time for any reason, including if you violate these Terms. Upon termination, you must stop using the Services immediately.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state in which Every Health LLC is based, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
