Acknowledgment of Receipt of HIPAA Notice of Privacy Practices
This Telehealth Consent to Treat Agreement outlines the terms and conditions of using Every Health LLC’s telehealth services (“Services”). By using the Services, you can access online consultations with independent, licensed healthcare professionals (“Providers”) and receive pharmacy services for any prescribed medications. Telehealth involves the delivery of healthcare services using electronic communications between a patient and a healthcare provider who are not in the same physical location.
1. Telehealth Services
Telehealth involves the remote delivery of healthcare services using electronic communication, including audio, video, or other data transmission technologies. Through telehealth, you can access consultations, diagnosis, treatment plans, and prescriptions without visiting a provider in person. Telehealth services may include, but are not limited to:
- The electronic transmission of medical records, photo images, personal health information, or other relevant data between a patient and a Provider.
- Real-time and asynchronous interactions via audio, video, secure messaging, or email communications.
- The use of remote monitoring devices, medical devices, or sound and video files for diagnosis or treatment.
Telehealth services offered by Every Health LLC may include:
- Online access to, and consultations with, licensed healthcare providers.
- Electronic transmission of medical information, including health records, photos, and test results.
- Remote monitoring and secure messaging.
- Pharmacy coordination for prescribed medications.
2. Potential Benefits of Telehealth
- More efficient, convenient, and cost-effective access to healthcare from your home or preferred location.
- Reduced travel time and cost associated with in-person visits.
- Access to licensed healthcare providers regardless of your geographic location.
- Access to care without the need for in-office appointments.
- Timely consultations scheduled on your time and at flexible hours.
3. Limitations of Telehealth
While telehealth offers many benefits, there are potential limitations, which may include:
- Insufficient information for medical decision-making, potentially requiring alternative or follow-up care.
- The inability to conduct physical exams or perform certain diagnostic tests that may be necessary for accurate diagnosis and treatment.
- Delays in care due to technical or system issues.
- Risks of data security breaches despite our safeguards.
- Restricted treatment options, particularly for certain prescriptions, due to regulatory requirements.
4. Consent to Telehealth Services
By agreeing to this Consent, you confirm that you:
- Have read, understand, and accept the risks and benefits associated with telehealth services.
- Authorize Every Health LLC’s services providers to provide medical services, including diagnosis, treatment, and prescription of medications, via telehealth.
- You give informed consent to receive telehealth care from Providers affiliated with Every Health LLC.
- Telehealth consultations may include technologies not explicitly described in this consent.
- No specific medical outcomes are guaranteed, and your condition may not improve and could potentially worsen.
- You agree to provide accurate and complete information regarding your health, medical history, and any changes.
- Misleading or inaccurate information may result in delays or potential harm.
- Providers may determine that telehealth is not appropriate for your condition and recommend alternative care.
- Telehealth consultations are designed to support, not replace, existing provider relationships.
- In a medical emergency, you must seek immediate in-person medical care by calling 911.
5. Payment Terms and Ongoing Treatment Plans
By using the telehealth services, you agree to be responsible for all costs of services rendered and acknowledge that all services are self-pay and prepaid.
By agreeing to this Consent to Treat Agreement and electing an ongoing treatment plan prescribed by a licensed healthcare provider, you authorize Every Health LLC to charge you on a recurring basis as outlined in our Terms of Use. Recurring billing applies to any treatment plans you choose to enroll in. For details on how recurring payments are processed, your responsibilities, and cancellation policies, please refer to our Recurring Billing Policy within the Terms of Use.
6. Consent to Receive Communications
You agree to receive service-related communications, including appointment reminders, test results, and updates, through email, text messages, or phone calls. Message and data rates may apply. You can adjust your communication preferences at any time through your account settings.
7. Withdrawal of Consent
You may withdraw your consent to receive telehealth services at any time by notifying us via email at info@everymeds.com. However, withdrawal of consent may affect our ability to provide you with ongoing care or services.
8. Privacy & Security
Your privacy is important to us. Every Health’s telehealth services are conducted using secure platforms to protect your health information.
- Your information, including personal health information, will be handled in accordance with our Privacy Policy.
- You have the right to access and review health information from telehealth consultations, subject to applicable laws.
- Your telehealth records will be shared with other healthcare providers only with your consent or at your request.
9. Termination of Telehealth Services
We reserve the right to terminate your access to telehealth services if you violate this agreement or if your condition requires in-person care that cannot be adequately addressed via telehealth.
10. Acknowledgment of HIPAA Compliance
Every Health LLC is committed to safeguarding your Protected Health Information (PHI) in accordance with HIPAA regulations. Your PHI will only be used or disclosed as necessary for your treatment, payment, or healthcare operations. For a detailed explanation of your rights regarding your health information, please review our HIPAA Notice of Privacy Practices. We prioritize the security of your health information and comply with the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
Privacy and Confidentiality: Your health information (Protected Health Information, or PHI) is treated with strict confidentiality. It will only be used for treatment, coordination of care, and legal or regulatory obligations.
Use and Disclosure: PHI will not be shared with third parties without your consent, except as permitted by law or necessary for healthcare operations, treatment, or payment purposes.
Security Measures: We implement administrative, physical, and technical safeguards, including encryption and secure communication channels, to protect PHI from unauthorized access or disclosure.
Breach Notification: In the unlikely event of a data breach involving your PHI, you will be promptly notified, as required by HIPAA.
Your Rights Under HIPAA:
- Access: You have the right to request copies of your telehealth consultation records.
- Amendment: You may request corrections if any information is inaccurate or incomplete.
- Accounting of Disclosures: You can request a list of disclosures made concerning your PHI.
- Restrictions: You may request limitations on certain uses and disclosures of your PHI.
- Confidential Communications: You can request that communications be sent through alternative means or locations to ensure privacy.

- Understand that telehealth is not a substitute for emergency or in-person care when necessary. If you do not agree to these terms, please do not proceed with using our telehealth services.
